Reporting claimed infringement
Your notice must include:
- your physical or electronic signature, as the copyright owner or a person authorized to act for them;
- identification of the copyrighted work you say is infringed (or, for several works, a representative list);
- identification of the material you say infringes, with enough information for us to find it, such as the full web address of each page or image;
- your name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
Knowingly misrepresenting that material is infringing can make you liable for damages (17 U.S.C. § 512(f)). Consider whether the use may be a fair use before you send a notice.
What we do with a notice
When we receive a complete notice we act quickly: we remove or disable access to the material, notify the customer whose website it is (with a copy of the notice), and tell them how to send a counter-notice. An incomplete notice may delay our response; we will tell you what is missing.
Material that we created for an unclaimed website proposal is our responsibility. If something in a proposal we prepared concerns you, email legal@websitegrowthlabs.com and we will review it and remove it promptly; you do not need to send a formal notice.
Counter-notices
If your material was removed and you believe it was a mistake or misidentification, send our agent a counter-notice that includes:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the US Federal District Court for the judicial district of your address (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We send the counter-notice to the person who sent the original notice. Unless our agent receives notice within 10 business days that they have filed a court action to restrain the activity, we restore the material between 10 and 14 business days after we received the counter-notice.
Repeat infringers
We terminate, in appropriate circumstances, the accounts of customers who repeatedly infringe copyright. As a rule, an account that receives three valid notices that are not successfully countered within 12 months is terminated; we may act sooner for clear or deliberate infringement.
We accommodate and do not interfere with standard technical measures that copyright owners use to identify or protect their works.
Canada
If you are in Canada, you can also send a notice under the notice-and-notice provisions of Canada's Copyright Act to the same address; we will forward it as that Act requires.
Other problems: report abuse
For problems that are not about copyright, such as phishing, malware, impersonation, trademark misuse, false or harmful content, or a privacy concern about a website we host, email legal@websitegrowthlabs.com with the website address and what is wrong. For personal-information requests you can also write to privacy@websitegrowthlabs.com. We review every report and act under our Terms of Service.
